International Law and Child Soldiers by Gus Waschefort
Robinson, JA
Long gone are the days that the law pertaining to children essentially dealt with the position of children within the parent-child relationship. On the contrary it has become a highly specialised legal discipline in which international and regional conventions progressively establish norms and standards to be adhered to. This book by Waschefort, the 53rd volume in the series Studies in International Law, bears ample testimony to this. It reviews all of the international instruments containing proscriptive norms to prohibit the use and recruitment of child soldiers. It commences with an analysis of the current state of child soldiering internationally, after which relevant international instruments are comprehensively discussed with a clear focus on the question of whether or not the prohibitive norms are optimally enforced – are they capable of better enforcement?

This book addresses an issue that may come as a surprise to most people, that is, the involvement of financiers and investors in socially responsible practices in the projects and companies that they finance and invest in. Focus is usually on the companies who potentially have a negative impact on the environment, but are they forgetting who and what makes the wheel turn? Should the financial sector not be subjected to the same standards? Maybe not as much on their direct ecological footprint, as they are normally not regarded as the largest polluters, but certainly on the indirect side as far as concerns their involvement in the financing of development projects and operations that could have a significant negative impact on the environment. Financial institutions should not be considered innocent suppliers of capital, without knowledge of or control over the use of the capital that they provide.

Government Intervention and Suburban Sprawl

The writer is of the opinion that government intervention is the probable cause of suburban sprawl in American cities. Two types of sprawl are discussed, namely, sprawl which results due to to the creation of suburbs and sprawl arising from the inability to be mobile without the use of one's personal transport. The writer makes use of comparative tables and statistics to add credibility to the findings. The school system, the creation of highways, making jay-walking a crime and the legal obligation to provide huge parking lots for shopping centres are some of the unusual reasons why there has been excessive sprawl in American cities.
Solutions are suggested to counter government intervention. Although the study is USA based, book could have universal appeal. However, as acknowledged by the writer, the cost that will have to be incurrred, may be a barrier.

This contribution is a review of a book on actions which may offend religious feelings even if it was not the intention of the offender to do so. This book illustrates how, drawings (amongst others) on the face of it, may be construed to be a mere exercise of the right to freedom of expression or free speech in a democratic society. This is regardless of the content of the drawing which, to other societies, may constitute an offence.

This contribution reviews the book titled Law and Religion in the Liberal State, and edited by two scholars, namely Md Jahid Hossain Bhuiyan and Darryn Jensen. The book contains a collection of papers dealing with the relationship between law and religion in liberal jurisdictions such as Great Britain, Europe, Italy, the USA, Australia and India. It also contains a few contributions that explore the relationship between religious freedom and certain traditions, such as Roman Catholicism and Orthodox Christianity. It also has a contribution on the theological ideas of Roger Williams, who is regarded as the founder of the Rhode Island's colony.

The contribution is the review published by former Deputy Chief Justice, Dikhang Moseneke, about his illustrious 15-year term in the Constitutional Court as both the judge and Deputy Chief Justice. The book uniquely provides a rare window into the dynamics of judicial decision-making at the apex court. Often, legal academics only interact with the judiciary through the judgements. Yet, Moseneke gives the reader much more to the judicial decision-making process than just the judgements. The book further traverses one of the most controversial aspects of the Constitutional Court’s jurisprudence, such as same-sex marriages, succession to chieftainship.

Book review: Canefe N Critical Perspectives on Crimes against Humanity: The Limits of Universal Jurisdiction in the Global South (University of Wales Press 2020)

In the current anti-accountability sentiment that has plagued most of Africa, triggered by the nasty politics of selectivity that is primarily motivated by considerations of realpolitik or the interests of specific states, Canefe's book lays bare the fundamental moral, legal and philosophical standpoint that advances the argument that perpetrators of mass atrocities must be held accountable. Unfortunately, the reality is different. She explores the vast (and almost impossible) impediments to attaining such an objective. Recognising the distinct and persuasive voices echoed by scholars from the Global South, the book examines the utilitarian effectiveness of using universal jurisdiction as a means towards this end. The critical views and responses of scholars who belong to TWAIL (an intellectual blog that is hotly and hardly contested by their counterparts from the Global North) expose, debunk and denounce the legitimacy of international law. The book argues that an international legal order that is largely mono-culturalistic, developed from selected principles, values and opinions from the West, cannot and should not be taken as a prototype of the global legal order. Instead, legal pluralism as a distinct feature of a diverse and multicultural world requires that a consensus is obtained: this is crucial if the world seeks to achieve what she calls a "neutralized universalization" of international law.
